MyPengo Mobile BV (hereinafter, the "Company"), as the owner of the website (hereinafter, the "Website" or the "Portal"), provides the following legal information:

2. Intellectual and Industrial Property

The Portal, its source code, design, services, digital content, images, videos, distinctive signs, and all other content are fully protected by intellectual and industrial property rights. These rights are owned by the Company or by third parties who have granted the Company a license to use their content. You are prohibited from distributing, copying, reproducing, communicating, disclosing, distributing, commercializing, or using for marketing purposes any of the Portal's content, in whole or in part, without the Company's prior express authorization.

3. Access to the Service

The Company offers a service for providing and creating digital entertainment content for users of compatible devices. This service operates under a subscription model with payment made via mobile bill charges. The service, known as Izeplay, offers a wide selection of games, videos, and articles. Once you complete the subscription process, you will have unlimited access to all digital content offered by the Company through the Portal. The content may be updated periodically at the Company's discretion. The subscription cost will be charged to the bill of the mobile operator with which the subscriber has a contract, whether it's a postpaid or prepaid plan.

4. User and Subscriber Status

A User is any person who accesses, navigates, or uses the Portal or the Service with the Subscriber's consent. The User may or may not be the same person as the Subscriber. The Subscriber is the owner of the phone line and number with a valid postpaid or prepaid contract with a mobile operator. The Subscriber may or may not be the same person as the User.

5. Service Compatibility

Check below to see if the content is compatible with your PC or device:

  • Games and Digital Content: Compatible with Mac, PC, tablets, and smartphones using any of the following browsers: Firefox, Safari, Chrome, and Edge.
  • Mobile Devices: iOS 12.0 or later, Android 6.0 or later
  • Desktop/Laptop: Windows 10+, macOS 10.14+, Linux (latest distributions)
  • Internet Connection: Minimum 2 Mbps for standard quality, 5 Mbps for HD content
  • Geographic Availability: United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Bahrain, Oman, Jordan, Lebanon, Egypt, Morocco, Tunisia, Algeria, and Iraq
  • Supported Carriers: Etisalat, du, STC, Mobily, Zain, Ooredoo, Viva, and other regional partners

Important: Some digital content is not compatible with Internet Explorer, iPhone versions older than iPhone 6, and Android versions older than 6.0. For the best experience, please ensure your browser and operating system are up to date.

6. Geographic and Carrier Restrictions

Izeplay services are currently available only in supported regions and through participating mobile network operators. Service availability is determined by IP-based geo-targeting and carrier verification. Users outside supported regions may access trial content but cannot subscribe to premium services. Data charges may apply according to your carrier's data plan.

7. Right of Withdrawal and Refund Policy

As a Subscriber, you have a 14-day period to withdraw from your purchase, starting from the date you contracted the Service. To exercise this right, you must clearly notify the Company within this period. Once you notify us, the Company will refund the amounts you paid within a maximum of 14 days. After the 14-day withdrawal period has expired, Customer Service will review each specific refund request on a case-by-case basis.

8. Guarantee of Conformity

The Service is guaranteed to be in compliance with the terms of your subscription. The legal warranty covers service functionality, compatibility, and features as established in this contract. You can exercise this guarantee by contacting our Customer Service department.

9. User and/or Subscriber Responsibilities

You may not use the Service for commercial purposes or any other use not defined in this agreement. You must respect intellectual and industrial property rights of third parties. The Subscriber must be of legal age to contract the Services. The owner of the phone line used for the subscription will always be responsible for payment.

10. Suspension of Accounts

The Company may temporarily suspend the account of any User or Subscriber who violates these terms and conditions. The Company also reserves the right to terminate the contractual relationship for any User's failure to comply with these terms.

11. Company Responsibility

The Company is responsible for providing the Services under the terms outlined above. Liability for unforeseen circumstances and/or force majeure is excluded. The Company will not be liable for any losses or damages you suffer as a result of your failure to comply with the obligations of this agreement.

13. Jurisdiction and Applicable Law

The Company, with its registered office in Netherlands, submits to the jurisdiction of the Courts and Tribunals of Netherlands. Any disputes, litigation, or claims shall be governed by and construed in accordance with Netherlands Federal Law.

14. Service Terms

This is not a subscription service. For each SMS sent to the short code 9009, there is a charge of €12 including VAT. By using this service, you confirm that you are at least 18 years old and agree to accept the general terms of use. There is no commitment, and you can stop using the service at any time by simply ceasing to send SMS messages to 9009.

15. Billing and Payments

You authorize us to charge your mobile operator for each SMS you send to the short code 9009. Each SMS sent to 9009 will result in a charge of €12 including VAT. Charges will appear on your mobile phone bill from your network operator. This is a pay-per-SMS service, meaning you are charged only for each SMS you send. You are responsible for all charges incurred for SMS messages sent to 9009.

16. Pricing Transparency

We guarantee complete transparency and consistency across all published pricing. The charge of €12 including VAT per SMS sent to 9009 is definitive and applies to each individual SMS message. There is no commitment, and you can stop using the service at any time by simply ceasing to send SMS messages to 9009. All pricing information is clearly communicated and consistently applied.
